Many businesses raise the question, “is WHS a legal requirement?”. Complying with Work Health & Safety legislation across Australia is a non-negotiable for all businesses (referred to in the legislation as PCBUs/persons conducting a business or undertaking).

The WHS Act outlines the responsibilities of the business (PCBU), management teams (Officers), workers (employees & contractors), and others (visitors).

What happens if we breach the legislation?
 

Contraventions of duties under the WHS Act and Regulations can result in significant penalties and potential prosecution by the respective state Regulator (note: penalties vary between states and their relevant legislation).
