The NSW Government’s 2025–26 Budget has introduced a major initiative to escalate and address psychosocial WHS breaches through a newly established service under SafeWork NSW. Here’s a breakdown of the key developments for the new regulator for psychosocial risks:

New Psychosocial Advisory Service

As part of a broader $344 million Workplace Mental Health package, the NSW Government is launching a Psychosocial Advisory Service that will:

  • Connect workers with expert support on psychological health and safety.
  • Escalate WHS breaches involving psychosocial hazards to dedicated psychosocial inspectors.
  • Be staffed by seven qualified professionals.
  • Deliver up to 25,000 consultations or assessments annually.
Budget Allocation Highlights

  • $127.7 million investment over four years to strengthen SafeWork NSW’s capacity.
  • Recruitment of 51 new inspectors, including:
    • 20 psychosocial-focused inspectors.
    • 5 psychosocial investigators.
  • SafeWork NSW will become an independent regulator from 1 July 2025, enhancing its enforcement powers.
What Changed on 1 July 2025 for SafeWork NSW?

Under the Work Health and Safety Amendment (Standalone Regulator) Act 2025, SafeWork NSW:

  • Separated from the Department of Customer Service.
  • Became a standalone executive agency.
  • Is now led by a newly appointed SafeWork Commissioner.
  • Is supported by a SafeWork Advisory Council to guide strategic direction and monitor emerging WHS risks.
Strategic Goals (2024–2026)

Outlined in the Psychological Health and Safety Strategy:

  • Increase compliance visits by 25% annually.
  • Ensure 125,000 workplaces take effective mental health action.
  • Target high-risk industries like healthcare, education, and public safety.
  • Focus on vulnerable groups including young workers, CALD communities, and small businesses.
What This Means for Employers

  • Expect more inspections and enforcement around psychosocial risks.
  • Be prepared to demonstrate compliance with WHS laws related to mental health.
  • Use available resources from SafeWork NSW to train staff, assess risks, and implement controls.
